Terms and Conditions

By making a booking, hiring, enquiring or obtaining a quote from All Over Productions Limited (now referred to as ‘the Company’), the Hirer / Client (now referred to as ‘You’) are entering into a legal contract (now referred to as ‘the/this/an agreement) by which You agree unconditionally to abide by the Company terms and conditions.1. General Terms- You must be at least 18 years of age to enter an agreement with the Company and You solely will be responsible for correspondence with the Company and abiding by this agreement unconditionally.- This agreement is subject to change at any time and without notification. You agree to conform with any amendments to this agreement from the time of its alteration.- Bookings are not confirmed until You have received correspondence from the Company to such effect.- The Company reserves the right to refuse service or hire without reason given. Fees may apply as outlined in this agreement.2. Equipment- All equipment is property of the Company or a third party and shall remain the property of the respective owner for the duration of the hire. The Company reserves the right to claim back any equipment hired at any time. You must not sell, offer to sell, lend or hire the equipment to any other person(s) at any time unless with express written permission from the Company.- Equipment must not be vandalised, damaged or in any other way altered beyond the manufacturers specifications by any person working, volunteering or attending any event where the Company is providing Services. You accept full liability should any of the above occur.3. Payments & Booking Fees- Payments should be made by BACs or Faster Payments. - It is your responsibility to pay for the full value of the invoice: prior to the hire commencing; or by the invoice due date; or by the terms agreed and in writing. The Company will not be held responsible for delays or cancellations of hires due to non-payment. Payment may still be due under the cancellation terms of this agreement where delay or cancellation is necessary, as decided by the Company.- A late fee of 10% of the invoice amount may be charged every 7 calendar days for each outstanding invoice until full payment is received, commencing as soon as the invoice becomes overdue, including weekends and public holidays. This fee may be waived at the companies discretion. An Invoice becomes overdue at 00:01am on the date the invoice is due.- All prices listed are exclusive of VAT.- Failure or refusal to pay may lead to prosecution, with any associated fees, settlements or compensation to be paid by You.4. Cancellations & Amendments- The minimum notice required for cancelling, altering or rescheduling a confirmed booking is 31 Business days, excluding weekends and public holidays.- Cancellations within 31 business days of a confirmed booking may incur a cancellation fee up to the full amount of any service provided by the Company.- Alterations, amendments and rescheduling are subject to availability and are made at the discretion of the Company.- Where equipment or services are owned/supplied by a third party supplier and cancellation fees apply, these fees will be passed on to You in their entirety.- The Company will not be liable for cancellations due to extreme weather, acts of Gods, terrorism, war or any unforeseen circumstances that are beyond our control. Cancellation is at the discretion of the Company.6. Damages- You are responsible for all equipment during the hire period or when equipment is in your possession outside of the hire period. - Repair or replacement costs of any damaged or lost equipment caused by, but not limited to: theft, fire, misuse, abuse or willful vandalism may be charged to You. - Equipment is not assumed to be insured by the Company; therefore it is solely your responsibility to insure equipment whilst in your possession and/or during the hire period. Equipment replacement values can be provided upon request for insurance purposes.- If the equipment is damaged or breaks prior to or during a hire, please report it to the Company immediately by emailing vincent@alloverproductions.co.uk. Failure to notify the Company will incur additional fees (such as, but not limited to: repair costs, replacement costs, compensation) if damage is found within 28 days of the hire end date. Notifying the Company does not constitute exclusion from additional charges where equipment damage is found.- Where equipment or services are owned/supplied by a third party supplier and they report damage caused by You which results in a fee being payable, these fees may be passed on to You in their entirety.- The Company is not liable for equipment failure during the hire but will look to rectify issues wherever possible and within reason. - You are responsible for ensuring any venue, temporary or permanent, is suitable for the planned event. This includes, but is not limited to: ensuring relevant power is provided at the correct voltages and currents; ensuring any necessary crowd control measures are in place; ensuring any structures are properly constructed and suitable; ensuring emergency exits are clearly marked and illuminated where relevant; ensuring fire safety procedures are met including regularly tested fire extinguisher where required or practical.7. Engineers & Delivery- Engineers can be booked upon request for setup, operation and pack down of equipment at the quoted rate, subject to availability. Standard cancellation terms apply, as per this agreement.- Delivery to and/or from your venue is charged at the quoted rate. - The Company is entitled to claim accommodation expenses for staff working events outside of Dorset over multiple days at the quoted nightly rate. Standard cancellation terms apply, as per this agreement.- Where Engineers are on-site for longer than 8 hours, food and drink should be provided or other arrangements agreed in advance. 8. Health & Safety- You or a nominated person is solely responsible for the Health & Safety of everyone working, volunteering or attending your event. Unless otherwise agreed in writing, the Company will not be responsible for the health and safety of any persons at any time.- If the Company feels that You or any part of your event do not conform to relevant health and safety regulations or guidelines, we reserve the right to stop work until it is safe to continue. If we are unable to complete the event due to safety concerns You may still be charged for our services. The Company will not be responsible for any expense required to amend any health and safety shortcomings.- The Company accepts no liability for any injury, loss or otherwise detrimental event or outcome to any parties.
